Welcome to our website! Before booking our boat trips, charters, or boat rentals, please read these Terms and Conditions carefully.
- 1. Booking and Deposit
1. Booking and Deposit
- 1.1. To confirm a booking, a prepayment of 20% of the total service cost is required.
- 1.2. The remaining balance must be paid on board on the day of the trip in cash, or via bank transfer at least 48 hours before the trip begins.
- 1.3. Final confirmation of the booking depends on availability and weather conditions.
- 1.4. The deposit is non-refundable in the event of cancellation by the client, except as provided in Section 2 (Cancellation Policy).
- 1.5. In the event of damage to the vessel or equipment caused by the client during the rental period, repair costs may be deducted from the security deposit after the trip and damage assessment, without prejudice to the cancellation policy described in Section 2.
- 1.6. Right of Withdrawal (for online bookings): If the booking was made online, you have the right to withdraw from the contract within 14 days from the booking date without giving any reason, except for services provided on a specific date or period (e.g., a specific date for a boat trip). To exercise the right of withdrawal, you must send us a written notice before the expiration of the cancellation deadlines specified in Section 2 (72 hours for boat trips and 10 days for charters and boat rentals). If the right of withdrawal is exercised within 14 days and before the expiration of the aforementioned cancellation deadlines, the deposit paid will be refunded. If the 14-day withdrawal period expires after the cancellation deadlines specified in Section 2, the deposit will not be refunded.
- 1.7. If the client cancels the booking after the withdrawal deadlines (Section 2), the deposit will be retained as compensation for losses incurred.
- 2. Cancellation Policy
- 2.1. Boat Trips (Single Day): Cancellation is possible up to 72 hours before departure, with the option to reschedule to another date (subject to availability and agreement with the company) or retain the deposit as a credit for a future service (valid for 12 months). Cancellation after this period or a no-show will result in the loss of the entire amount paid.
- 2.2. Charters and Boat Rentals: Cancellation is possible up to 10 days before the start of the service, with the option to reschedule to another date (subject to availability and agreement with the company) or retain the deposit as a credit for a future service (valid for 12 months). Cancellation after this period or a no-show will result in the loss of the entire amount paid.
- 2.3. In the event of cancellation by our company due to adverse weather conditions that directly threaten navigation safety (the decision is made exclusively by the Captain based on the vessel’s navigation area limitations and safety requirements), serious vessel breakdown, or other documented force majeure events, the client will be offered a full refund or the opportunity to reschedule the service to another date (subject to availability).
- 2.4. Any rescheduling of the service must be agreed with our company and depends on the availability of free slots. Only one change of booking date is permitted.
- 2.5. In the event of a client no-show without prior notice, the full price of the booked service will be retained.
- 2.6. Cancellation notifications or rescheduling requests from the client must be sent to divine.boats@gmail.com or made by phone at +351 962 811 966.
- 3. Lost Property
- 3.1. Clients are responsible for the safety of their personal belongings on board.
- 3.2. We are not liable for the loss, damage, or theft of clients’ personal items.
- 3.3. Any loss must be reported immediately to a crew member.
- 3.4. Found items will be stored for 30 days. Storage beyond this period may be subject to a fee. The costs of returning found items shall be borne by the client. After 30 days, unclaimed items may be disposed of.
- 4. Privacy
- 4.1. We only collect personal data necessary for providing our services (name, contact details, payment information, as well as data required for Portuguese maritime manifests), in accordance with the General Data Protection Regulation (GDPR).
- 4.2. Your data is used to manage bookings, communicate with you, process payments, and, if necessary, be transferred to the insurance company Fidelidade Companhia de Seguros, S.A. (and its assistance partners) to fulfill obligations under the mandatory passenger accident insurance policy.
- 4.3. You have the right to access, rectify, erase, and exercise other rights regarding your personal data in accordance with the GDPR. Requests should be directed to divine.boats@gmail.com.

- 5. Additional Provisions
- 5.1. By booking our services, you confirm that you have read, understood, and agreed to these Terms and Conditions.
- 5.2. In accordance with Portuguese law (Decreto-Lei n.º 186/2015), the company holds a mandatory group passenger accident insurance policy on board (Fidelidade Policy No. AG65616810). This policy covers medical treatment expenses, sanitary transportation, and repatriation, as well as the risks of death or permanent disability resulting from an accident during maritime activities, up to the established limits and with no deductible (no franchise). To cover risks unrelated to activities on board (e.g., chronic medical conditions, loss of baggage outside the vessel, or personal choice to cancel the tour), clients are advised to arrange their own standard travel insurance.
- 5.3. Clients are strictly required to comply with the rules of conduct on board and unconditionally follow the instructions of the skipper (captain) and crew, especially during water activities (diving, snorkeling, swimming) and fishing tours (spinning, jigging, trolling). Violating safety regulations or direct commands from the captain may result in the insurance company denying coverage. The company is not liable for injury or property damage caused by the client’s own fault, negligence, or imprudence.
- 5.4. We reserve the right to alter the itinerary due to safety reasons or other objective factors without prior notice.
- 5.5. By booking, you agree that photos and videos taken during the trip may be used by us for marketing purposes, unless you express explicit disagreement before the trip begins.
- 5.6. We reserve the right to amend these Terms and Conditions, which shall take effect from the date of their publication on the website.
